BARTON WEISS is a transactional entertainment attorney and former senior business and legal affairs executive serving as Of Counsel to Boyarski Fritz LLP.
Bart’s expertise includes complex commercial contract negotiation and drafting; music rights and agreements, including recorded music, music publishing and audio-visual deals; domestic and international licensing deals; content production and distribution; joint ventures; service and consultant agreements; digital media rights agreements; copyright infringement issues; sponsorship, talent and endorsement agreements; venue and live event agreements; marketing, advertising and promotion matters; IP clearances and licenses; executive employment and consultancy contracts; content acquisitions and divestitures (including due diligence); and confidentiality/non-disclosure agreements.
Prior to his current private practice, Bart has held top-level positions at some of the music industry’s leading companies. Most recently, Bart was Lead Music Counsel for Mattel, Inc., the world’s largest toy company. There, Bart worked closely with Mattel executives on matters across all Mattel brands (including Hit Entertainment, Fisher-Price, Barbie, Monster High, American Girl and Hot Wheels) and handled all music-related deals, in addition to consumer product agreements, content production agreements, talent agreements, consulting agreements, vendor agreements, advertising/marketing agreements, digital agreements, app development agreements, business alliance agreements and many other types of transactions.
Prior to Mattel, Bart was the VP of Legal Affairs/Head of Royalty Audit at EMI Music where he headed a royalty audit team comprised of attorneys and finance personnel and was responsible for disposition of over $100 million in audit and breach of contract claims involving superstar recording artists such as The Beatles, Katy Perry, The Beach Boys, Smashing Pumpkins, Blondie, Bob Seger and many others.
Before EMI, Bart was the Vice-President of Business & Legal Affairs at Razor & Tie Entertainment/Kidz Bop, LLC where he structured and negotiated complex domestic and foreign contracts dealing with music publishing and recording deals, intellectual property rights, merchandising, joint ventures and content/brand exploitation.
From 2004 to 2010, Bart was a Legal/Business Affairs Consultant at Sony Music Entertainment where he negotiated and drafted licenses and agreements for superstar artists including Jennifer Lopez, Beyonce, AC/DC, Carole King, Bob Dylan, Johnny Cash and many others. There, he was lead counsel on the valuation, sell-off and licensing of the iconic Sony Wonder video catalog.
Bart started his career as an attorney at Arista Records, before becoming the VP of Legal & Business Affairs at EMI Music Publishing, where he served as a key executive in all facets of the company’s legal affairs. Bart also spent 2 years as a private practitioner at the entertainment firm of Bienstock & Michael.
